El mar\u00e7 de 2019 es va publicar al BOE el Reial Decret Llei 7\/2019, de l&#8217;1 de mar\u00e7, que fa refer\u00e8ncia a la <strong>Llei d&#8217;Arrendaments Urbans (<span class=\"hiddenSpellError\">LAU<\/span>)<\/strong>. Aquest nou Reial Decret Llei va entrar en vigor l&#8217;endem\u00e0 de la seva aplicaci\u00f3, per\u00f2 no \u00e9s de car\u00e0cter retroactiu, de manera que els contractes d&#8217;arrendament signats amb anterioritat a aquesta no es veuran afectats.<\/p>\n<p>El mar\u00e7 de 2020, el Govern va aprovar <a href=\"https:\/\/www.finquesmarba.com\/ca\/coronavirus-arrendador-arrendatari\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>mesures especials sobre els lloguers a causa de l&#8217;estat d&#8217;alarma provocat pel coronavirus<\/strong><\/a>. Aquestes mesures van plantejar diferents escenaris tant per arrendadors com per a llogaters.<\/p>\n<p>A m\u00e9s, el setembre de 2020, el Parlament de Catalunya va aprovar la <strong>\u00abLlei de mesures urgents en mat\u00e8ria de contenci\u00f3 de rendes en els contractes d&#8217;arrendament d&#8217;habitatge\u00bb<\/strong>, que afecta els contractes signats a Catalunya a partir del 22 de setembre de 2020 i que estableix que, en zones amb manca d\u2019habitatge assequible, el cost queda vinculat a l\u2019<strong>\u00cdndex de l\u2019Ag\u00e8ncia de l\u2019habitatge de Catalunya<\/strong>.<\/p>\n<p><strong>Tant si vols llogar la teva propietat com si busques un habitatge de lloguer, hi ha aspectes imprescindibles que haur\u00e0s de con\u00e8ixer en tancar el teu pr\u00f2xim acord.<\/strong> A continuaci\u00f3 et detallem (de m\u00e9s nova a m\u00e9s antiga), les diferents versions de la Llei del lloguer que han estat en vigor durant els \u00faltims dos anys i que poden afectar segons la data en qu\u00e8 hagis signat contracte.<\/p>\n\n<p>[\/et_pb_text][et_pb_text admin_label=&#8221;Extensi\u00f3 de les mesures especials del coronavirus&#8221; box_shadow_vertical_tablet=&#8221;0px&#8221; box_shadow_blur_tablet=&#8221;40px&#8221; box_shadow_spread_tablet=&#8221;0px&#8221; z_index_tablet=&#8221;500&#8243;]<\/p>\n<h2>Extensi\u00f3 de les mesures especials sobre lloguers a causa del\u00a0coronavirus<\/h2>\n<p>Les mesures especials sobre lloguers que es van aprovar amb l&#8217;arribada de l&#8217;estat d&#8217;alarma el mar\u00e7 de 2020 estaven vigents fins al 31 de gener de 2020. El dimarts 26 de gener, <strong>algunes d&#8217;aquestes mesures es van ampliar fins al 9 de maig de 2021<\/strong>, dia en el qual acabar\u00e0 l&#8217;estat d&#8217;alarma.<\/p>\n<p>Les mesures ampliades s\u00f3n:<\/p>\n<ul>\n<li><strong>Pr\u00f2rrogues obligat\u00f2ries<\/strong> de sis mesos per als contractes que vencen durant la pand\u00e8mia.<\/li>\n<li><strong>Morat\u00f2ries de pagament<\/strong> a qu\u00e8 poden acollir-se determinats inquilins.<\/li>\n<\/ul>\n<p>L&#8217;administraci\u00f3 va decidir que els inquilins els contractes d&#8217;arrendament estan a punt de v\u00e8ncer poden sol\u00b7licitar que el contracte d&#8217;arrendament s&#8217;estengui per sis mesos, i el propietari ha d&#8217;acceptar-ho. <strong>La norma no considera que es pugui sol\u00b7licitar m\u00e9s d&#8217;una pr\u00f2rroga<\/strong>, i per aix\u00f2 en principi el canvi no afectar\u00e0 els inquilins que ja s&#8217;hagin acollit a aquesta mesura. La seva funci\u00f3 \u00e9s permetre que aquells inquilins que rescindeixin els seus contractes entre l&#8217;1 de febrer i el 9 de maig sol\u00b7licitin una pr\u00f2rroga de sis mesos a l&#8217;arrendador. box_shadow_vertical_tablet=&#8221;0px&#8221; box_shadow_blur_tablet=&#8221;40px&#8221; box_shadow_spread_tablet=&#8221;0px&#8221; z_index_tablet=&#8221;500&#8243;]<\/p>\n<h2>Llei catalana de regulaci\u00f3 del preu dels lloguers<\/h2>\n<p>Des\u00a0del 22 de setembre de 2020 els lloguers a Catalunya estan subjectes a la nova &#8220;Llei de mesures urgents en mat\u00e8ria de contenci\u00f3 de rendes en els contractes d&#8217;arrendament d&#8217;habitatge&#8221;, <strong>pensada per evitar abusos en el preu dels lloguers en zones amb falta d&#8217;habitatge assequible.<\/strong> No canvia les condicions dels contractes que estiguessin vigents abans de la seva entrada en vigor.<\/p>\n<p>El no compliment d&#8217;aquesta llei pot implicar <strong>sancions d&#8217;entre 3.000 i 90.000 euros<\/strong> segons la infracci\u00f3.<\/p>\n<p>Aquesta norma ha estat <strong>recorreguda davant el Tribunal Constitucional<\/strong> per partits de l&#8217;oposici\u00f3 i el recurs ha estat adm\u00e8s a tr\u00e0mit el gener de 2021. Aix\u00ed i tot, aix\u00f2 no implica per ara la suspensi\u00f3 de la llei, que segueix vigent.<\/p>\n<h3>1. Preus fixats per l&#8217;\u00cdndex de l&#8217;Ag\u00e8ncia d&#8217;Habitatge de Catalunya<\/h3>\n<p>Els nous contractes <strong>s&#8217;han d&#8217;ajustar al preu\/<span class=\"hiddenSpellError\">m2<\/span>\u00a0de refer\u00e8ncia que estableix l&#8217;\u00cdndex de l&#8217;Ag\u00e8ncia d&#8217;Habitatge de Catalunya<\/strong> a partir dels preus dels contractes de lloguer de la zona en la qual es troba l&#8217;habitatge.<\/p>\n<p>Si l&#8217;immoble ha estat arrendat per sota del preu de refer\u00e8ncia durant els darrers\u00a0<span class=\"hiddenGreenError\">5<\/span>\u00a0anys, <strong>el propietari no podr\u00e0 encarir el lloguer.<\/strong> A m\u00e9s, la nova llei permet rebaixar els preus que ara estan per sobre de l&#8217;\u00cdndex i congela els que se situen per sota.<\/p>\n<p><strong>Els habitatges poden incrementar un 5% el preu respecte a l&#8217;\u00cdndex<\/strong>, si compleixen, almenys, tres d&#8217;aquestes caracter\u00edstiques especials:<\/p>\n<ul>\n<li>Ascensor<\/li>\n<li>Aparcament<\/li>\n<li>Calefacci\u00f3 o aire condicionat<\/li>\n<li>Jardins o piscines comunit\u00e0ries<\/li>\n<li>Servei de consergeria<\/li>\n<li>Vistes<\/li>\n<li>Mobles<\/li>\n<\/ul>\n<h3>2. \u00c0rees amb &#8220;mercat tens&#8221; i adaptabilitat a cada municipi<\/h3>\n<p>La norma es pot aplicar a barris o districtes en qu\u00e8 hi hagi manca d&#8217;habitatge assequible sense necessitat que afecti la resta del municipi, pr\u00e8via <strong>declaraci\u00f3 de la zona com &#8220;mercat tens&#8221;<\/strong>. La declaraci\u00f3 t\u00e9 una durada de 5 anys (prorrogables a altres 5) i pot quedar sense efecte si les causes que han portat a ella desapareixen.<\/p>\n<p>Aquesta declaraci\u00f3 es d\u00f3na quan:<\/p>\n<ul>\n<li>L&#8217;\u00e0rea en q\u00fcesti\u00f3 experimenta un creixement sostingut clarament superior al de la mitjana de Catalunya.<\/li>\n<li>El preu del lloguer supera el 30% dels ingressos habituals de les llars o de la renda mitjana de les persones menors de\u00a0<span class=\"hiddenGreenError\">35<\/span>\u00a0anys.<\/li>\n<li>O el preu de l&#8217;habitatge ha crescut 3 punts per sobre de l&#8217;IPC en els \u00faltims\u00a0<span class=\"hiddenGreenError\">5<\/span>\u00a0anys.<\/li>\n<\/ul>\n<p>La situaci\u00f3 generada per la COVID-19 ha fet que es declarin &#8220;mercat tens&#8221; de forma autom\u00e0tica 61 municipis.<\/p>\n<p>La Llei d\u00f3na als ajuntaments, a m\u00e9s, d\u00f3na <strong>marge per flexibilitzar la norma i adaptar-la a les necessitats concretes de cada municipi.<\/strong> Les seves propostes poden minorar o incrementar el preu de l&#8217;\u00cdndex en un 5% i poden excloure de la norma els pisos que sumin m\u00e9s de 150 metres quadrats.<\/p>\n<h3>3. En cas que la part arrendadora sigui una <strong>persona jur\u00eddica, el per\u00edode de contracte obligatori s&#8217;ampliar\u00e0 fins als 7 anys.<\/strong><\/p>\n<\/li>\n<li>\n<h3>Pr\u00f2rroga t\u00e0cita de\u00a0<span class=\"hiddenGreenError\">3<\/span>\u00a0anys al venciment del contracte<\/h3>\n<p><strong>Per a les persones f\u00edsiques, s&#8217;amplia tamb\u00e9 la pr\u00f2rroga t\u00e0cita d&#8217;1 a 3 anys.<\/strong> \u00c9s a dir, si cap de les dues parts del\u00a0contracte\u00a0de lloguer presenta la voluntat de no renovar el contracte, aquest es perllongar\u00e0. En cas que no es vulgui procedir a una pr\u00f2rroga, l&#8217;arrendador ha de notificar a l&#8217;inquil\u00ed la voluntat de no renovar el contracte amb\u00a0<span class=\"hiddenGreenError\">4<\/span>\u00a0mesos d&#8217;antelaci\u00f3 i, en cas que sigui l&#8217;arrendatari, haur\u00e0 de notificar amb un marge de\u00a0<span class=\"hiddenGreenError\">2<\/span>\u00a0mesos.<\/p>\n<\/li>\n<li>\n<h3>M\u00e0xim 2 mensualitats de fian\u00e7a en els contractes de 5 anys de durada<\/h3>\n<p>La nova Llei d&#8217;Arrendaments Urbans pret\u00e9n promoure la millora de l&#8217;habitatge i potenciar el mercat de lloguer. Fins al moment, aquest era un aspecte no\u00a0del\u00a0tot regulat per la qual cosa l&#8217;arrendador podia exigir la quantitat que volgu\u00e9s a l&#8217;inquil\u00ed. Actualment, s&#8217;ha establert una regulaci\u00f3 que exigeix que si l&#8217;arrendador\u00a0\u00e9s persona jur\u00eddica <strong>nom\u00e9s es pot\u00a0demanar un m\u00e0xim de dos mesos de fian\u00e7a<\/strong> abans d&#8217;entrar a viure en un habitatge.<\/p>\n<\/li>\n<li>\n<h3>Suspensi\u00f3 de desnonaments davant indicis de vulnerabilitat<\/h3>\n<p>Els serveis socials poden interrompre en cas que s&#8217;informi d&#8217;una situaci\u00f3 de vulnerabilitat per part de l&#8217;arrendatari i fins que es trobi una alternativa. <strong>El desnonament de l&#8217;habitatge es paralitzar\u00e0 per un per\u00edode d&#8217;un mes en el cas que el propietari sigui un individu i de tres mesos si es tracta d&#8217;una persona jur\u00eddica.<\/strong><\/p>\n<\/li>\n<li>\n<h3>Despeses de gesti\u00f3 immobili\u00e0ria i contracte a c\u00e0rrec de l&#8217;arrendador<\/h3>\n<p>La nova mesura decreta que les <strong>despeses de gesti\u00f3 immobili\u00e0ria i de formalitzaci\u00f3 del contracte aniran a c\u00e0rrec de l&#8217;arrendador<\/strong> quan aquest sigui una persona jur\u00eddica, sempre que les despeses no hagin estat iniciativa de l&#8217;inquil\u00ed.<\/p>\n<\/li>\n<li>\n<h3>Rebaixes d&#8217;impostos<\/h3>\n<p>Es limiten les pujades anuals de la renda a l&#8217;increment de l&#8217;IPC de tots els contractes. Mentre duri el contracte, no podr\u00e0 incrementar-se m\u00e9s de l&#8217;IPC de la renda del lloguer. A partir del 23 de gener de 2019, totes les aplicacions que es van dur a terme van quedar eliminades. No obstant aix\u00f2, si vas signar el teu contracte de lloguer durant el per\u00edode de temps en qu\u00e8 la llei va estar vigent, \u00e9s a dir, entre els dies 19 de desembre de 2018 i 22 de gener de 2019, els efectes s\u00ed que et seran aplicats.<\/p>\n<p>Si, per contra, has signat el teu contracte entre el 23 de gener de 2019 i el 4 de mar\u00e7 de 2019, aquestes s\u00f3n les condicions que s&#8217;apliquen:<\/p>\n<h3 class=\"p1\">1. Els contractes de lloguer\u00a0tornen a ser de 3 anys<\/h3>\n<p class=\"p1\">La nova llei d&#8217;arrendaments contemplava\u00a0que els contractes podien tenir una durada de 5 anys. Actualment aquests s&#8217;han modificat tornant\u00a0als 3 anys\u00a0inicials.<\/p>\n<h3 class=\"p1\">2. Les pr\u00f2rrogues t\u00e0cites es redueixen de 3 a 1\u00a0any<\/h3>\n<p class=\"p1\">Si\u00a0passats els 3 anys del contracte ni arrendador ni arrendatari presenten la voluntat de no renovar el contracte, aquest es prolongar\u00e0 1 any m\u00e9s.<\/p>\n<h3 class=\"p1\">3. Les fiances depenen de l&#8217;acord entre totes dues parts<\/h3>\n<p class=\"p1\">Amb la llei antiga, els arrendataris podien establir \u00fanicament 2 mesos de fian\u00e7a com a quantitat m\u00e0xima. Despr\u00e9s de l&#8217;eliminaci\u00f3 d&#8217;aquesta, es torna a la legislaci\u00f3 passada en la qual l&#8217;arrendador pot sol\u00b7licitar les garanties que cregui oportunes o que s&#8217;estableixin en l&#8217;acord entre les dues parts interessades.<\/p>\n<h3 class=\"p1\">4. Les despeses de gesti\u00f3 a c\u00e0rrec de l&#8217;arrendatari<\/h3>\n<p class=\"p1\">Despr\u00e9s de la derogaci\u00f3 de la llei, les despeses de gesti\u00f3 immobili\u00e0ria i de formalitzaci\u00f3 de contracte seran a c\u00e0rrec de l&#8217;arrendatari.<\/p>\n<h3 class=\"p1\">5. Els contractes d&#8217;arrendament redu\u00efts queden a exempts de sotmetre&#8217;s a l&#8217;IPC<\/h3>\n<p class=\"p1\">Quant als arrendaments de renda redu\u00efda, \u00e9s a dir, aquells contractes inferiors a\u00a0600\u20ac\u00a0i amb durades de fins a 5 anys, l&#8217;increment produ\u00eft com a conseq\u00fc\u00e8ncia de la revisi\u00f3 que es duia a terme anualment, no podia excedir l&#8217;\u00faltim IPC. Ara nom\u00e9s es revisar\u00e0 la quantitat del lloguer si s&#8217;ha pactat pr\u00e8viament.<\/p>\n<h3 class=\"p1\">6. Les garanties addicionals dels desnonaments queden eliminades<\/h3>\n<p class=\"p1\">Amb la llei antiga, els serveis socials podien interrompre els desnonaments en cas que s&#8217;inform\u00e9s d&#8217;una situaci\u00f3 de vulnerabilitat i, per tant, el proc\u00e9s quedaria paralitzat durant un temps determinat. box_shadow_vertical_tablet=&#8221;0px&#8221; box_shadow_blur_tablet=&#8221;40px&#8221; box_shadow_spread_tablet=&#8221;0px&#8221; z_index_tablet=&#8221;500&#8243;]<\/p>\n<h2 class=\"p1\">Llei d&#8217;Arrendaments Urbans, 18 de desembre de 2018<\/h2>\n<p>El 18 de desembre de 2018 va entrar en vigor una nova llei de lloguer que modificava de manera parcial la Llei d&#8217;Arrendaments Urbans (<span class=\"hiddenSpellError\">LAU<\/span>), per\u00f2 no es va convalidar i va quedar sense vig\u00e8ncia el 23 de gener\u00a0del\u00a02019.<\/p>\n<p>Tot i aix\u00f2, si vas signar el teu contracte entre el 19 de desembre de 2018 i el 22 de gener de 2019, t&#8217;afecten els seg\u00fcents aspectes:<\/p>\n<ol>\n<li>\n<h3>S&#8217;amplia la durada m\u00ednima dels contractes a 5 anys<\/h3>\n<p class=\"p1\">Mentre que fins al moment els contractes de lloguer tenien una durada m\u00ednima de 3 anys, ara han de tenir <strong>un per\u00edode de durada de 5 anys<\/strong>. En cas que la part arrendadora sigui una <strong>persona jur\u00eddica, el per\u00edode de contracte obligatori s&#8217;ampliar\u00e0 fins als 7 anys.<\/strong><br \/>Cal destacar que aquesta mesura afecta \u00fanicament als contractes vigents des del 18 de desembre, ja que no tenen car\u00e0cter retroactiu.<\/p>\n<\/li>\n<li>\n<h3>Pr\u00f2rroga t\u00e0cita de 3 anys al venciment del contracte<\/h3>\n<p class=\"p1\">Per a les <strong>persones f\u00edsiques,\u00a0s&#8217; amplia tamb\u00e9 la pr\u00f2rroga t\u00e0cita d&#8217;1 a 3 anys<\/strong>. \u00c9s a dir, si cap de les dues parts del contracte de lloguer presenta la voluntat de no renovar el contracte, aquest es prolongar\u00e0.<\/p>\n<\/li>\n<li>\n<h3>M\u00e0xim 2 mensualitats de fian\u00e7a<\/h3>\n<p class=\"p1\">La nova Llei d&#8217;Arrendaments Urbans pret\u00e9n promoure la millora de l&#8217;habitatge i potenciar el mercat del lloguer. Fins al moment, aquest era un aspecte no del tot regulat pel que l&#8217;arrendador podia exigir la quantitat que volgu\u00e9s a l&#8217;inquil\u00ed. Actualment, s&#8217;ha establert una regulaci\u00f3 que exigeix que<strong> nom\u00e9s es pot demanar un m\u00e0xim de dos mesos de fian\u00e7a abans d&#8217;entrar a viure en un habitatge.<\/strong><\/p>\n<\/li>\n<li>\n<h3>Suspensi\u00f3 de desnonaments davant indicis de vulnerabilitat<\/h3>\n<p>Els serveis socials poden interrompre&#8217;ls en cas que s&#8217;informi d&#8217;una situaci\u00f3 de vulnerabilitat per part de l&#8217;arrendatari i fins que es trobi una alternativa. <strong>El desnonament de l&#8217;habitatge es paralitzar\u00e0 per un per\u00edode d&#8217;un mes en cas que el propietari sigui un individu i de dos mesos si es tracta d&#8217;una persona jur\u00eddica.<\/strong><\/p>\n<\/li>\n<li>\n<h3>Nova modalitat: Contractes d&#8217;arrendament de renta redu\u00efda<\/h3>\n<p class=\"p1\">La nova llei fa refer\u00e8ncia a aquells contractes amb rendes per sota de la renda establerta per al pa\u00eds. Seran declarats <strong>contractes d&#8217;arrendament de renda redu\u00efda tots aquells l&#8217;actualitzaci\u00f3 anual dels quals de la renda no superi l&#8217;\u00faltim IPC publicat.<\/strong><\/p>\n<\/li>\n<li>\n<h3>Despeses de gesti\u00f3 immobili\u00e0ria a c\u00e0rrec de l&#8217;arrendador<\/h3>\n<p class=\"p1\">La nova mesura decreta que les <strong>despeses de gesti\u00f3 immobili\u00e0ria i de formalitzaci\u00f3 del contracte aniran a c\u00e0rrec de l&#8217;arrendador<\/strong> quan aquest sigui una persona jur\u00eddica, sempre que les despeses no hagin estat iniciativa de l&#8217;inquil\u00ed.<br \/>D&#8217;altra banda, \u00e9s important destacar que sempre que hi hagi acord entre les dues parts<strong> es podran realitzar obres de millora en el pis<\/strong> sense necessitat d&#8217;esperar a que s&#8217;acabi el contracte.<\/p>\n<\/li>\n<li>\n<h3><span style=\"font-size: 22px;\">Rebaixes d&#8217;impostos<\/span><\/h3>\n<p>Quant als impostos, es retoca la Llei Reguladora de les Hisendes Locals incorporant mesures que afavoreixen al mercat del lloguer de l&#8217;habitatge. En aquesta s&#8217;expressa que<strong> deixa de ser obligatori repercutir l&#8217;IBI a l&#8217;arrendatari en el lloguer social de l&#8217;habitatge per part d&#8217;Administracions o ens p\u00fablics.<\/strong><\/p>\n<p class=\"p1\">A l&#8217;\u00e0rea fiscal i amb l&#8217;objectiu de reduir les c\u00e0rregues que suposa el mercat del lloguer, seran <strong>exemptes d&#8217;Impost de Transmissions Patrimonials i Actes Jur\u00eddics Documentats totes aquelles subscripcions dels contractes d&#8217;arrendaments d&#8217;habitatge per a \u00fas estable i permanent.<\/strong><\/p>\n<\/li>\n<\/ol>\n<p class=\"p1\">Cal destacar que la nova llei de lloguer tamb\u00e9 fa refer\u00e8ncia\u00a0als\u00a0<strong>ajuntaments<\/strong>:<\/p>\n<ul>\n<li class=\"p1\">Aquells ajuntaments amb m\u00e9s ingressos que despeses, \u00e9s a dir, amb super\u00e0vit, podran destinar la taxa a promoure el seu parc d&#8217;habitatge p\u00fablic.<\/li>\n<li class=\"p1\">S&#8217;instaura la possibilitat que s&#8217;estableixi una bonificaci\u00f3 de fins al 95% en la quota de l&#8217;IBI per als habitatges subjectes a lloguer a preu limitat.<\/li>\n<li class=\"p1\">S&#8217;introdueix la definici\u00f3\u00a0d&#8217;
