Al venedor se l&#8217;obliga a lliurar-li els t\u00edtols de pertinen\u00e7a de la propietat i proporcionar-li al comprador una conservaci\u00f3 i cust\u00f2dia de l&#8217;habitatge i, en cas de deterioraci\u00f3 del pis, el venedor est\u00e0 comprom\u00e8s a respondre davant les p\u00e8rdues que pugui tenir la casa.<\/p>\n<p>Per tant, el contracte de compravenda \u00e9s de prec\u00eds compliment, a excepci\u00f3 que totes dues parts arribin a un acord, en el qual es contempli una indemnitzaci\u00f3 que afavoreixi a la part complidora. Tot aix\u00f2, en el cas que un dels dos incompleixi l&#8217;acord del contracte de compra i venda. Aix\u00f2 significa que, en aquest tipus de contracte no est\u00e0 contemplada la resoluci\u00f3 contractual.<\/p>\n<h2>Model de contracte d&#8217;arres<\/h2>\n<p>El <strong>contracte d&#8217;arres<\/strong> \u00e9s un dret reservat, que es refereix a l&#8217;anul\u00b7laci\u00f3 a la compra o la venda de la propietat, penalitzant a qualsevol de les dues parts que hagi incomplit el contracte de senyal. En aquest sentit, el comprador perdr\u00e0 la fian\u00e7a que lliur\u00e9s en el moment de formalitzaci\u00f3. De la mateixa manera, el venedor es veur\u00e0 tamb\u00e9 afectat pel contracte d&#8217;arres, veient-se en la tessitura de retornar el doble del dip\u00f2sit. Per aix\u00f2, abans de signar les escriptures del pis, hem d&#8217;estar informats de les quantitats a lliurar en el concepte d&#8217;arres.<\/p>\n<p>Resulta rellevant assenyalar que, per a evitar possibles conflictes entre totes dues parts, el contracte d&#8217;arres ha de reflectir i expressar correctament quines s\u00f3n les intencions de tots dos.<\/p>\n<p><strong>El contracte d&#8217;arres inclou una s\u00e8rie de dades que \u00e9s necessari tenir en compte abans de formalitzar l&#8217;escriptura del pis:<\/strong><\/p>\n<ul>\n<li>Hem d&#8217;identificar les condicions de l&#8217;habitatge, el preu estipulat i el m\u00e8tode de pagament.<\/li>\n<li>Preparar l&#8217;escriptura p\u00fablica de compravenda per a convertir-se en propietari i fer-se c\u00e0rrec de la plusv\u00e0lua municipal.<\/li>\n<li>Hem d&#8217;estar al corrent del termini de la prestaci\u00f3 de l&#8217;escriptura p\u00fablica de compravenda davant el notari i tenir clar pr\u00e8viament quines s\u00f3n totes les conseq\u00fc\u00e8ncies jur\u00eddiques que assumirem en el moment de l&#8217;atorgament.<\/li>\n<\/ul>\n<p>No es podr\u00e0 realitzar l&#8217;entrega de claus de l&#8217;habitatge fins que no es dugui a terme l&#8217;atorgament d&#8217;escriptura p\u00fablica.<\/p>\n<h2>El t\u00edtol de la propietat<\/h2>\n<p>Abans de res, assegura&#8217;t de qui o qui s\u00f3n els propietaris de l&#8217;habitatge que vols comprar. Amb el <strong>t\u00edtol de la propietat<\/strong> sabr\u00e0s qui \u00e9s el propietari de l&#8217;immoble. En aquest document s&#8217;especifica la data i la forma en la qual es va adquirir el pis.
