box_shadow_vertical_tablet=&#8221;0px&#8221; box_shadow_blur_tablet=&#8221;40px&#8221; box_shadow_spread_tablet=&#8221;0px&#8221; z_index_tablet=&#8221;500&#8243;]<\/p>\n\n<h2>En qu\u00e8 consisteix el lloguer amb opci\u00f3 de compra?<\/h2>\n<p>El lloguer amb opci\u00f3 de compra permet a un llogater <strong>viure en un habitatge en r\u00e8gim de lloguer<\/strong> durant un temps determinat (estipulat al contracte) i, un cop acabat aquest per\u00edode, l&#8217;inquil\u00ed t\u00e9 <strong>dret a comprar la propietat per un preu fixat<\/strong> pr\u00e8viament (a l&#8217;hora de fer el contracte).<\/p>\n<h3>Com \u00e9s contracte de lloguer amb opci\u00f3 de compra?<\/h3>\n<p>El contracte de lloguer amb opci\u00f3 de compra <strong>no \u00e9s un contracte tipificat<\/strong>, sin\u00f3 que <strong>\u00e9s un contracte mixt<\/strong>, compost per dos subcontractes diferents:<\/p>\n<ul>\n<li>Un contracte de lloguer<\/li>\n<li>Un contracte de compravenda<\/li>\n<\/ul>\n<p>Encara que est\u00e0 acceptat al Reglament Hipotecari i est\u00e0 regulat per la Llei d&#8217;Arrendaments Urbans (LAU), <strong>no el contempla cap llei ni est\u00e0 incl\u00f2s al Codi Civil<\/strong>.<\/p>\n<p>Les parts tenen certa llibertat per acordar quines cl\u00e0usules apareixeran al contracte, encara que sempre <strong>han de respectar les bases del contracte de lloguer i del contracte de compravenda.<\/strong><\/p>\n<p>En el cas del <strong>contracte de compravenda<\/strong> que forma part del contracte de lloguer amb dret a compra, aquest <strong>es considera un precontracte<\/strong> segons el qual una de les parts concedeix a l&#8217;altra la facultat de decidir si l&#8217;executa o no. \u00c9s a dir, l&#8217;arrendador-propietari ofereix una oportunitat de compra a l&#8217;arrendatari-comprador, que pot decidir utilitzar-la o no.<\/p>\n<ul>\n<li>El contracte de lloguer amb dret a compra <strong>\u00e9s un contracte d&#8217;execuci\u00f3 per etapes<\/strong>. En un primer moment s&#8217;executa com a contracte de lloguer ordinari, per\u00f2, en acabar el per\u00edode marcat, l&#8217;inquil\u00ed haur\u00e0 de decidir si compra o no l&#8217;habitatge.<\/li>\n<li><strong>El preu de la compravenda queda fixat en el moment de fer el contracte<\/strong> i, en el cas que es faci la compra, <strong>es descomptar\u00e0 del preu de venda la suma acumulada d&#8217;aquestes mensualitats<\/strong> (totalment o parcialment, segons s&#8217;hagi fixat).<\/li>\n<\/ul>\n<h4>Contracte de lloguer amb opci\u00f3 a compra amb entrega inicial<\/h4>\n<p>En el moment d&#8217;elaborar el contracte de lloguer amb opci\u00f3 de compra <strong>es pot fixar un lliurament inicial o una prima<\/strong> que, posteriorment, es descomptar\u00e0 del preu de compra en cas d&#8217;executar-se la compravenda.<\/p>\n<p>Si finalment l&#8217;inquil\u00ed no opta a comprar l&#8217;habitatge o desisteix del contracte de lloguer abans que s&#8217;acabi, <strong>aquesta prima es perd<\/strong>, segons el que estableix el contracte.<\/p>\n<p>[\/et_pb_text][et_pb_divider _builder_version=&#8221;3.23.2&#8243;
