box_shadow_vertical_tablet=&#8221;0px&#8221; box_shadow_blur_tablet=&#8221;40px&#8221; box_shadow_spread_tablet=&#8221;0px&#8221; z_index_tablet=&#8221;500&#8243;]<\/p>\n\n<p>\u00a0<\/p>\n<h2>Qu\u00e8 \u00e9s la plusv\u00e0lua municipal i per qu\u00e8 ha canviat<\/h2>\n<p>El nom real del conegut com a impost de plusv\u00e0lua \u00e9s <strong>Impost sobre l&#8217;Increment del Valor dels Terrenys de Naturalesa Urbana<\/strong> i grava les operacions de venda, donaci\u00f3 o successi\u00f3 d&#8217;habitatges. <strong>S&#8217;aplica sobre l&#8217;import de revaloraci\u00f3 de l&#8217;habitatge des que s&#8217;adquireix <\/strong>fins que es deixa de posseir.<\/p>\n<p>\u00c9s un impost directe que gestionen els ajuntaments i ha hagut de modificar-se a correcuita, ja que, fa unes setmanes, <strong>el Tribunal Constitucional va declarar &#8220;inconstitucionals i nuls&#8221; <\/strong>els <strong>tres apartats<\/strong> de l&#8217;article 107 de la Llei Reguladora de les Hisendes Locals <strong>que regulen el c\u00e0lcul<\/strong> base imposable de l&#8217;impost.<\/p>\n<p>La decisi\u00f3 es va basar que el cadastre que elaboren els municipis t\u00e9 uns barems fixats per norma que <strong>no tenen en compte l&#8217;evoluci\u00f3 real del valor dels terrenys on s&#8217;ubica un habitatge.<\/strong> Aix\u00f2 donava lloc a una manera de calcular l&#8217;impost que determinava que sempre hi havia increment en el valor dels terrenys i s&#8217;aplicava hi hagu\u00e9s o no enriquiment per part del venedor.<\/p>\n<p>La <strong>nova llei de plusv\u00e0lua municipal<\/strong> pret\u00e9n tornar la seguretat jur\u00eddica a contribuents i ajuntaments, i <strong>ha entrat en vigor el dimecres 10 de novembre de 2021<\/strong>.<\/p>\n<h3>\u00c9s obligatori pagar la plusv\u00e0lua municipal?<\/h3>\n<p>La plusv\u00e0lua \u00e9s un impost de car\u00e0cter potestatiu (no obligatori) i <strong>\u00e9s cada Ajuntament qui decideix si acorda la seva imposici\u00f3 i si ho regula<\/strong> mitjan\u00e7ant ordenan\u00e7a fiscal.<\/p>\n<p>Si al teu municipi est\u00e0 regulat, has de saber qui el paga en cada cas:<\/p>\n<ul>\n<li><strong>Venda d&#8217;un habitatge: <\/strong>\u00e9s el venedor qui ha de pagar l&#8217;impost, ja que \u00e9s el que rep els diners de la venda.<\/li>\n<li><strong>Donaci\u00f3 d&#8217;un habitatge:<\/strong> la persona que pren l&#8217;immoble \u00e9s la que ha de fer front al pagament de l&#8217;impost.<\/li>\n<li><strong>Habitatge heretat:<\/strong> els hereus tenen l&#8217;obligaci\u00f3 de pagar la plusv\u00e0lua municipal.<\/li>\n<\/ul>\n<blockquote>\n<p>Et pot interessar: <a href=\"https:\/\/www.finquesmarba.com\/ca\/despeses-en-vendre-un-piso\/\" target=\"_blank\" rel=\"noopener noreferrer\">Quines s\u00f3n les despeses en vendre un pis: impostos i despeses claus<\/a><\/p>\n<\/blockquote>\n<p>[\/et_pb_text][et_pb_divider _builder_version=&#8221;3.23.2&#8243;
