que el Govern va publicar el diumenge 29 de mar\u00e7 despr\u00e9s de limitar les activitats permeses a causa del coronavirus.<\/p>\n<p>Seguint les indicacions de la Instrucci\u00f3 dictada el 15 de mar\u00e7 de 2020 per la Direcci\u00f3 General de Seguretat Jur\u00eddica i Fe P\u00fablica, en coordinaci\u00f3 amb el Consell General del Notariat, sobre les mesures a adoptar per garantir l&#8217;adequada prestaci\u00f3 de servei p\u00fablic notarial, els notaris han adaptat la seva activitat i el servei de notaries est\u00e0 assegurat durant el per\u00edode que duri l&#8217;estat d&#8217;alarma.<\/p>\n<p>Per la seva banda, el Col\u00b7legi de Registradors assegura que els Registres de la Propietat, Mercantils i B\u00e9ns Mobles romandran oberts per tractar-se d&#8217;un servei p\u00fablic d&#8217;inter\u00e8s general. Per a aix\u00f2, els registres s&#8217;han adaptat per evitar despla\u00e7aments i mantenir el servei sense interrupcions.<\/p>\n<h2>Com s&#8217;han adaptat al coronavirus?<\/h2>\n<p><strong>Els notaris<\/strong>, per la seva banda, <strong>demanen que no s&#8217;acudeixi a les notaries sense cita pr\u00e8via<\/strong>, ja que no estan obertes al p\u00fablic, <strong>i nom\u00e9s atenen personalment q\u00fcestions d&#8217;urg\u00e8ncia<\/strong>. trabajando?<\/h2><p>S\u00ed,<strong> tanto los notarios como los registradores han estado trabajando desde que se decret\u00f3 el estado de alarma<\/strong> y sus funciones se han sido incluidas dentro de la lista de \u201cactividades esenciales\u201d que el Gobierno public\u00f3 el domingo 29 de marzo tras limitar las actividades permitidas a causa del coronavirus.<\/p><p>Siguiendo las indicaciones de la Instrucci\u00f3n dictada el 15 de marzo de 2020 por la Direcci\u00f3n General de Seguridad Jur\u00eddica y Fe P\u00fablica, en coordinaci\u00f3n con el Consejo General del Notariado, sobre las medidas a adoptar para garantizar la adecuada prestaci\u00f3n del servicio p\u00fablico notarial, los notarios han adaptado su actividad y el servicio de notar\u00edas est\u00e1 asegurado durante el periodo que se prolongue el estado de alarma.<\/p><p>Por su parte, el Colegio de Registradores asegura que los Registros de la Propiedad, Mercantiles y Bienes Muebles permanecer\u00e1n abiertos por tratarse de un servicio p\u00fablico de inter\u00e9s general. Para ello, los registros se han adaptado para evitar desplazamientos y mantener el servicio sin interrupciones.<\/p><h2>\u00bfC\u00f3mo se han adaptado al coronavirus?<\/h2><p><strong>Los notarios<\/strong>, por su parte, <strong>piden que no se acuda a las notar\u00edas sin cita previa<\/strong>, ya que no est\u00e1n abiertas al p\u00fablico, <strong>y s\u00f3lo atienden personalmente cuestiones de urgencia<\/strong>. Adem\u00e1s, las citas presenciales se est\u00e1n espaciando para que no haya aglomeraciones en las notar\u00edas y, as\u00ed, poder mantener la distancia de seguridad sanitaria recomendada en todo momento.<\/p><p>A la hora de realizar una gesti\u00f3n de urgencia, el notario ser\u00e1 quien indique en cada caso c\u00f3mo debe realizarse. Lo m\u00e1s frecuente es que se pida a las personas con cita que acudan solas, a no ser, por ejemplo, que necesiten ayuda.<\/p><p>Durante el estado de alarma <strong>los notarios no est\u00e1n autorizados a desplazarse fuera de sus notar\u00edas<\/strong>. Solo podr\u00edan hacerlo en casos muy excepcionales y si la junta de gobierno del colegio notarial del que dependan as\u00ed lo autoriza.<\/p><p>En el caso de <strong>los registradores de la propiedad, realizan atenci\u00f3n personal de manera exclusiva por tel\u00e9fono o correo electr\u00f3nico<\/strong>. Para ello, recomienda la presentaci\u00f3n de documentaci\u00f3n de forma telem\u00e1tica por motivos de seguridad colectiva, aunque tambi\u00e9n permiten su presentaci\u00f3n por mensajer\u00eda y, en caso de necesidad, f\u00edsicamente.<\/p><p>Adem\u00e1s, si debes hacer uso de alguno de sus servicios, debes tener en cuenta que <strong>durante el estado de alarma quedan suspendidos los plazos de prescripci\u00f3n y caducidad <\/strong>tanto de los registros de la propiedad, mercantiles y de bienes inmuebles, como de los documentos ante notario.<\/p><h2>\u00bfQu\u00e9 tr\u00e1mites de notar\u00eda se pueden realizar?<\/h2><p>Si tienes alg\u00fan tr\u00e1mite pendiente, se recomienda que localices el notario m\u00e1s cercano a tu vivienda y llames o le escribas un correo explicando tu situaci\u00f3n. <strong>Ser\u00e1 el notario quien considere la urgencia de la gesti\u00f3n<\/strong> y te dar\u00e1 cita e instrucciones si realmente no puede esperar.<\/p><p>Por ejemplo, las operaciones bancarias s\u00ed que est\u00e1n consideradas urgentes (p\u00f3lizas de pr\u00e9stamo o cr\u00e9dito, pr\u00e9stamos o cr\u00e9ditos hipotecarios, etc.), as\u00ed como tambi\u00e9n puede ser considerado urgente el caso de unas arras dadas que est\u00e9n a punto de vencer. C\u00f3mo no se han suspendido los plazos civiles, una situaci\u00f3n as\u00ed ser\u00eda considerada urgente para otorgar una escritura.<\/p><p><strong>Los registradores de la propiedad<\/strong>, por su parte, <strong>s\u00f3lo atienden de forma presencial cuestiones que consideren de grave urgencia<\/strong> y que ya se hayan gestionado previamente por v\u00edas telem\u00e1ticas.<\/p><p>As\u00ed pues, <strong>son notarios y registradores quienes valoran la condici\u00f3n de urgencia de un registro o firma<\/strong>, ya sea un testamento o la firma de una \/><\/h2><h2>\u00bfC\u00f3mo afecta el coronavirus a la firma de compraventas e hipotecas?<\/h2><p>Los notarios y los registradores de la propiedad tienen un <strong>papel central en el sector inmobiliario<\/strong>, por eso, su situaci\u00f3n actual puede tener incidencia en c\u00f3mo se gestionan las diferentes operaciones inmobiliarias que se estuviesen realizando antes del inicio del estado de alarma. \u00bfC\u00f3mo afecta a cada caso?<\/p><h3>Firma de escrituras<\/h3><p><strong>Si la firma ya estaba programada, lo mejor es contactar con la notar\u00eda<\/strong> que fuese a hacerse cargo y se aplazar\u00e1 o se mantendr\u00e1 (adoptando las medidas de seguridad necesarias) seg\u00fan su urgencia.<\/p><p>En el caso de que la firma est\u00e9 sujeta a un plazo (cuando las partes se han suscrito a un contrato privado de compraventa con arras, por ejemplo), <strong>los firmantes pueden acordar un aplazamiento<\/strong> de la fecha l\u00edmite para escriturar mediante la redacci\u00f3n de un anexo al contrato privado de compraventa firmado por las dos partes<\/p><h3>Solicitud de hipotecas<\/h3><p>Ya que los bancos siguen prestando servicios, <strong>la solicitud de hipotecas sigue operativa<\/strong>. Los bancos contin\u00faan analizando solicitudes, aunque el proceso puede ser m\u00e1s lento al haber menos disponibilidad en las sucursales.<\/p><h3>Firma de hipotecas<\/h3><p>Aunque la solicitud de hipotecas funciona normalmente, el proceso de validaci\u00f3n y firma de las mismas <strong>s\u00ed que sufrir\u00e1 contratiempos<\/strong>. Cuando se decret\u00f3 el estado de alarma, muchos <strong>tasadores<\/strong> dejaron de visitar inmuebles, pero otros tantos siguieron realizando su labor. Con el cese de la actividad no esencial, <strong>esta actividad ha quedado en un limbo legal<\/strong>. La normativa aprobada por el Gobierno hace referencia a los trabajadores por cuenta ajena, pero no se aplica a los aut\u00f3nomos y es la Asociaci\u00f3n Espa\u00f1ola de An\u00e1lisis de Valor (AEV) quien debe concretar c\u00f3mo les afecta esta nueva situaci\u00f3n durante los pr\u00f3ximos d\u00edas.<\/p><p>Como los bancos no pueden emitir ofertas definitivas ni mandar documentaci\u00f3n a los notarios sin los informes de tasaci\u00f3n, <strong>la firma de hipotecas durante estas semanas ser\u00e1 complicada<\/strong>. Adem\u00e1s, en el caso de que se dispusiese de informe de tasaci\u00f3n y de que el banco enviase todos los documentos, la \u00faltima palabra sobre la urgencia del tr\u00e1mite la sigue teniendo el notario.<\/p><p>\u00a0<\/p><p>Si crees que tienes un tr\u00e1mite notarial que no puede esperar o est\u00e1s en pleno proceso de compraventa o de firma de una hipoteca, contacta con el notario o registrador m\u00e1s cercano a tu domicilio y cons\u00faltale. \u00c9l o ella te asesorar\u00e1n sobre qu\u00e9 puedes hacer o te ofrecer\u00e1n posibles soluciones.
